Simplex Lawn Care LLC Terms Of Service


These Terms of Service govern services provided by Simplex Lawn Care LLC, and its affiliates, subsidiaries, and assigns (collectively referred to as “Simplex Lawn Care”). By approving an estimate, scheduling service, or using our services, you agree to these terms.

1. Payment Terms

We offer payment options including card payments, cash, and check by mail.

All services are post-pay unless otherwise stated. Snow removal services may require prepayment depending on the agreement.

Invoices are due within seven (7) days of the invoice date unless otherwise stated in writing.

A late fee of $10 or ten percent (10%) of the outstanding balance (whichever is greater) may be applied weekly to unpaid balances.

We do not accept partial payments unless previously approved in writing. Unpaid balances may be subject to collections, and the customer agrees to pay all reasonable collection costs, court costs, and attorney fees incurred.

Recurring services are billed monthly for services rendered during the previous month. Services performed between the first (1st) and last day of the month will be invoiced on or around the first (1st) of the following month, unless otherwise stated.

2. Card on File Authorization

Customers may place a card on file for convenience. By placing a card on file, you authorize Simplex Lawn Care LLC to charge your card for services rendered, recurring services, approved additional services, late fees, cancellation fees, seasonal agreements, and any amounts due under service agreements.

For one-time services, payment is due upon completion unless otherwise stated. For recurring services, payment is due according to the monthly billing cycle outlined in these Terms.

Card on file may be required for customers with a history of late payments.

3. Scheduling and Service Timing

Service dates are approximate and may change due to weather conditions, routing efficiency, equipment availability, or operational needs.

We cannot guarantee specific service times. Requests for specific arrival times may not be accommodated.

4. Property Access and Preparation

Customers are responsible for ensuring safe and clear access to all service areas.

If we are unable to access portions of the property due to locked gates, vehicles, animals, or other obstructions, those areas may be skipped and the service will still be billed at the normal rate.

We will make reasonable efforts to resolve access issues when possible.

5. Weather Conditions

Services may be delayed or rescheduled due to weather conditions including rain, lightning, extreme temperatures, saturated ground, snow, or other unsafe conditions.

Weather-related delays do not constitute breach of service, and services will be completed at the next available opportunity.

6. Damage and Liability

Simplex Lawn Care is not responsible for damage caused by pre-existing property conditions, hidden or unmarked obstacles, or weak or inadequately installed fixtures. Customers are responsible for removing obstacles and marking hazards prior to service.

We may refuse to service areas deemed unsafe, including steep slopes, unstable ground, or conditions that pose a risk to equipment or personnel.

We are not responsible for damage caused by prior contractors, pre-existing property conditions, weak fencing, wet or unstable ground, or normal wear to turf on slopes.

If clearly marked irrigation heads or fixtures are damaged due to our negligence, liability is limited to repair or replacement of the damaged component only.

For safety reasons, we do not mow non-grass surfaces.

7. Service Pricing and Adjustments

Service pricing is based on property conditions as described by the customer and/or reasonably observable at the time of estimate. If actual property conditions differ from what was described or previously observed, pricing may be adjusted accordingly. Adjustments may be made prior to or upon arrival at the time of service.

Overgrown, thick, or neglected lawns may require additional time, multiple passes, or adjusted service methods. Additional charges may apply based on property condition at the time of service. Severely overgrown lawns may require multiple visits to restore normal maintenance conditions.

If service is paused, skipped, or delayed at the customer’s request, resulting overgrowth or condition changes may impact service time, method, and cost upon return.

8. Refund Policy

If a service does not meet the agreed scope, the customer must notify Simplex Lawn Care within forty-eight (48) hours of service completion.

We will be given the opportunity to correct the issue. Refunds will only be issued if the issue cannot reasonably be resolved through a redo.

Refund determinations are made at the sole discretion of Simplex Lawn Care based on the circumstances of each situation.

No refunds will be issued for completed services affected by weather conditions, property conditions, or factors outside our control.

9. Cancellation Policy

Cancellation or rescheduling of one-time or non-recurring services requires at least forty-eight (48) hours notice.

Late cancellations may be charged up to fifty percent (50%) of the scheduled service price.

We reserve the right to waive cancellation fees at our discretion in cases of emergencies or unforeseen circumstances.

10. Ongoing Service Agreements

Recurring or ongoing services, including lawn mowing and seasonal service agreements, require a minimum of thirty (30) days written notice to cancel.

Services may continue to be performed and billed during the notice period.

The forty-eight (48) hour cancellation policy applies only to one-time or non-recurring services unless otherwise stated in writing.

11. Safety and Service Conditions

Customers are responsible for removing obstacles including toys, hoses, furniture, decorations, and similar items prior to service.

Pet waste must be removed prior to service. If pet waste is present, we may skip affected areas, reschedule service, or proceed with additional charges due to increased labor and sanitation requirements. Simplex Lawn Care is not responsible for the spread or disturbance of pet waste during service. Excessive conditions may result in additional charges.

We are not responsible for damage caused by pre-existing property conditions or hidden obstacles.

We may refuse service to unsafe areas or conditions at our discretion.

12. Lawn Mowing Services

Season: May 1 – October 15

Lawn mowing services include mowing agreed service areas, trimming around obstacles, blowing clippings from hard surfaces, and minimal debris removal.

We do not collect sticks or large debris.

Sloped or unsafe areas may be excluded at our discretion.

Overgrown conditions are governed under the Pricing and Adjustments section.

13. Spring and Fall Cleanup Services

Services include leaf removal, stick removal, and blowing of hard surfaces.

Stick removal is limited to reasonable size material.

Excessive debris conditions may result in additional charges.

We are not responsible for debris that accumulates after service completion.

14. Core Aeration Services

Aeration includes soil perforation and core distribution across the lawn surface.

Customers must mow prior to service and ensure moderate soil moisture.

Customers must mark all underground utilities and irrigation systems. We are not responsible for damage to unmarked items.

Unsafe or obstructed areas may be skipped at our discretion.

Timing is based on customer preference, lawn condition, and scheduling availability.

15. Snow Removal Services

Season: November 1 – March 31

Snow removal services are triggered at two (2) inches of accumulation unless otherwise stated in the service agreement or estimate.

Service timing depends on storm conditions, accumulation rate, drifting, ice, municipal plowing, and operational routing.

Multiple visits may occur during extended or heavy snowfall events at our discretion.

Snowfall occurring outside the seasonal period is billed separately at per-visit rates.

16. Documentation

We reserve the right to photograph properties for documentation, quality assurance, and dispute resolution purposes.

17. Changes to Terms

Simplex Lawn Care reserves the right to update these Terms of Service at any time. Continued use of services constitutes acceptance of any revisions.
